Prohibited Items Policy

You may only list an item if:

• you own it or otherwise have the legal right to sell it;
• you are legally permitted to sell it;
• the item is permitted under this policy;
• your description and photographs accurately represent the item;
• you disclose any material damage, defects, modifications or other issues you are aware of that could affect its safety, value or use; and
• the listing complies with applicable law and our other policies.

Prerode may prohibit items even where their ownership or sale is not itself unlawful.

The fact that an item is not specifically mentioned in this policy does not necessarily mean that it may be listed.

You must not list:

• stolen bicycles, components or accessories;
• an item that you do not own or do not otherwise have the legal right to sell;
• an item subject to finance, hire, lease or another agreement that prevents you from legally selling it;
• an item reported as stolen on BikeRegister, Immobilise or another relevant property register;
• a bicycle or component whose identifying or serial number has been unlawfully removed, intentionally obscured or altered; or
• an item accompanied by false or misleading evidence of ownership.

We may ask a seller to provide reasonable evidence that they own an item or have the right to sell it.

If we reasonably suspect that an item is stolen, we may remove the listing, restrict the account, preserve relevant information where permitted or required by law, and report the matter to the police, Action Fraud or another appropriate authority.

Counterfeit goods are prohibited.

You must not list:

• counterfeit bicycle frames, components, clothing, helmets or accessories;
• replica or imitation products presented as genuine branded products;
• products carrying a manufacturer's branding without authorisation where doing so infringes intellectual property rights;
• genuine products accompanied by fabricated receipts, service records, warranty information or provenance; or
• an item using a brand name, model name or description in a way that falsely suggests the item was manufactured, approved or authorised by that brand.

For example, an unbranded or open-mould frame must not be presented as a genuine Specialized, Santa Cruz, Yeti or other branded frame unless it genuinely is one.

Selling counterfeit branded goods can also amount to a criminal offence under the Trade Marks Act 1994 and an unfair commercial practice under the Digital Markets, Competition and Consumers Act 2024.

Sellers are responsible for ensuring that descriptions of branded goods are accurate.

You must not list an item where you know, or reasonably should know, that it presents a serious safety risk.

This includes:

• products subject to a safety recall where the recall requires the product to be withdrawn, returned, repaired or no longer used (recalls affecting the UK can be checked on the Office for Product Safety and Standards (OPSS) product recall register);
• cracked or seriously damaged frames or structural components where their continued use would be unsafe;
• carbon components with known structural damage, delamination or unsafe repairs;
• suspension components with known structural or catastrophic failures;
• damaged, swollen, leaking, modified or otherwise unsafe lithium-ion batteries;
• counterfeit or otherwise unsafe helmets or protective equipment; and
• products whose sale is prohibited or restricted under applicable product-safety law, including the General Product Safety Regulations 2005 and, for personal protective equipment such as helmets, the Personal Protective Equipment (Enforcement) Regulations 2018.

Known damage, repairs and modifications that do not make an item prohibited must still be accurately disclosed in the listing where they could reasonably affect a buyer's decision or the safe use of the item.

Prerode may remove a listing where we reasonably believe an item presents a safety risk, even if the seller disagrees with that assessment.

Safety equipment must be accurately described.

You must not knowingly list a helmet or other protective product where:

• it has suffered damage that may materially compromise its protective function;
• it is subject to an applicable safety recall that makes continued use or resale unsafe;
• it is counterfeit; or
• you know that it is otherwise unsafe for its intended use.

Where relevant, sellers should disclose the age, condition and known impact history of used protective equipment.

Buyers should independently assess whether used safety equipment is appropriate for their intended use.

Prerode permits electrically assisted pedal cycles (EAPCs) that comply with the requirements applicable to their use in Great Britain.

As a marketplace rule, Prerode does not permit listings for:

• electric bicycles designed or modified to provide motor assistance beyond the limits applicable to an EAPC, unless Prerode expressly introduces a category permitting such vehicles;
• de-restricted or "chipped" electric bicycles;
• devices or modifications primarily intended to defeat an e-bike's applicable speed or power restrictions;
• electric bicycles falsely described as road-legal EAPCs;
• unsafe or materially modified electrical systems; or
• damaged, swollen, leaking or otherwise unsafe e-bike batteries.

Under the Electrically Assisted Pedal Cycles Regulations 1983 (as amended), an EAPC in Great Britain must have a maximum continuous rated motor power of 250W, motor assistance that cuts off once the bicycle reaches 15.5 mph (25 km/h), and pedals that can propel it. A rider must be at least 14 years old. An electric bicycle that does not meet these requirements is likely to be treated as a motor vehicle, meaning that it would require registration, insurance, tax, an appropriate driving licence and type approval before it could be used on a road or other public place.

It is the seller's responsibility to accurately describe the bicycle and any modifications.

Prerode may prohibit categories of electric bicycles even where ownership of the bicycle itself is lawful.

Damaged or unsafe lithium-ion batteries must not be listed.

In particular, you must not list a battery that you know is:

• swollen;
• leaking;
• significantly physically damaged;
• subject to a safety recall requiring it to be withdrawn from use;
• dangerously modified; or
• otherwise unsafe.

While Prerode operates as an in-person marketplace without integrated delivery, users must not use Prerode to arrange the unlawful transportation of dangerous or restricted goods.

If Prerode introduces delivery services in the future, additional restrictions may apply.

Prerode is a cycling marketplace and does not permit weapons to be listed.

This includes:

• firearms and firearm components regulated under the Firearms Act 1968;
• air weapons;
• crossbows and crossbow components regulated under the Crossbows Act 1987;
• knives, bladed articles, offensive weapons and corrosive products restricted under the Offensive Weapons Act 2019, the Criminal Justice Act 1988 or the Restriction of Offensive Weapons Act 1959;
• weapons prohibited or restricted under applicable UK law; and
• items marketed or intended primarily for use as weapons.

As a general marketplace rule, standalone knives and other age-restricted bladed products may not be listed on Prerode, even where their sale might otherwise be lawful, because Prerode is a cycling classifieds service and we do not operate the age-verification and delivery controls required by sections 38 to 42 of the Offensive Weapons Act 2019.

Ordinary bicycle tools and cycling equipment are not prohibited merely because they contain a blade or sharp component (for example a multi-tool with a chain-breaker), provided they are lawful and are genuinely being sold for their ordinary cycling purpose.

Cycling protective equipment such as helmets, knee pads, elbow pads and ordinary cycling body protection is permitted, subject to the safety requirements in this policy.

You must not list an item that infringes another person's intellectual property rights.

This includes counterfeit goods and unauthorised reproductions that infringe trademarks, copyright, registered designs or other applicable rights.

Examples may include counterfeit:

• frames and components;
• cycling clothing;
• team jerseys;
• event merchandise;
• helmets;
• eyewear; and
• accessories.

Rights holders may report suspected infringement using the notice-and-takedown procedure described in our Acceptable Use Policy.

Prerode must not be used for a transaction that would breach financial or trade sanctions imposed under the Sanctions and Anti-Money Laundering Act 2018 or another sanctions regime applicable to us or to you.

Users must not use Prerode to sell, purchase or otherwise make goods or economic resources available, directly or indirectly, to a person designated on the UK sanctions list maintained by the Office of Financial Sanctions Implementation (OFSI), or where the transaction would otherwise breach applicable sanctions law.

Consistent with Section 2 of our Terms of Service, you must not be subject to a UK, EU, UN or US sanctions list. Prerode may restrict listings, transactions or accounts where we reasonably consider this necessary to comply with applicable sanctions or other legal obligations.

Unless Prerode expressly permits them in a particular category, you must not list:

• cars;
• motorcycles;
• mopeds;
• motor scooters;
• fuel-powered tools;
• unrelated household goods;
• services such as coaching, bike fitting or training plans;
• digital-only products, licences or downloads;
• empty packaging sold without the relevant product;
• receipts or proofs of purchase sold separately;
• standalone warranty transfers;
• speculative listings;
• group buys;
• pre-orders; or
• items that the seller does not currently possess or have the right to sell.

Bicycles designed for cargo, disability or adaptive use are permitted where they otherwise comply with this policy.

Listings, photographs, usernames and profile information must also comply with our Acceptable Use Policy.

Listings must not contain:

• pornographic or sexually explicit content;
• sexual or exploitative content involving minors;
• hate speech or content promoting hatred against protected groups;
• unlawful threats or harassment;
• content promoting or facilitating illegal activity;
• materially misleading information about the item; or
• contact or payment information included for the purpose of circumventing Prerode's rules or safety systems.

Incidental appearance of people in legitimate photographs of an item is not prohibited, but users should avoid unnecessarily including identifiable children or other third parties in listing photographs.

You must describe your item accurately.

You must not:

• knowingly conceal significant damage or defects;
• falsely describe an item as new, genuine or unused;
• use photographs of a different item in a misleading way;
• provide a false model, specification, age or size;
• falsely claim that an item has been professionally inspected, serviced or repaired;
• provide fabricated service records, receipts or ownership documents; or
• make a materially misleading claim about an item's safety, condition, provenance or legal status.

Where you list an item as a trader, misleading actions or omissions are also unfair commercial practices under Chapter 1 of Part 4 of the Digital Markets, Competition and Consumers Act 2024, and traders are separately subject to the Consumer Rights Act 2015 and, for distance sales, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Failing to declare that you are acting as a trader when you are one is itself an offence under section 226 of the Digital Markets, Competition and Consumers Act 2024.

Normal differences of opinion about the condition or value of a used item do not necessarily amount to a policy breach.

Prerode currently facilitates listings and communication between users but does not process payment or provide delivery services.

Unless we expressly introduce another transaction method, buyers and sellers are responsible for arranging payment and collection directly.

Users should inspect an item before completing a purchase where reasonably possible, particularly its condition, identifying numbers and any evidence of ownership.

You must not use an in-person transaction to sell an item that would otherwise be prohibited by this policy.

We may take action where we reasonably believe that a listing, item or user breaches this policy, our other terms or applicable law, or creates a material fraud or safety risk.

Depending on the circumstances, we may:

• remove or restrict a listing;
• request additional information or evidence;
• issue a warning;
• temporarily restrict an account;
• suspend or permanently close an account;
• prevent further listings;
• preserve information where permitted or required by law; or
• report suspected unlawful activity to an appropriate authority.

We may take action without prior notice where reasonably necessary, including in cases involving suspected stolen property, fraud, counterfeit safety equipment, serious safety risks or unlawful activity.

Repeated breaches may result in account suspension or closure. A single serious breach may also result in immediate suspension or closure.

Please provide the listing URL or other identifying information and a short explanation of your concern.

If you believe a bicycle has been stolen, you may also wish to report the matter directly to the police and relevant bicycle/property registration services.

If there is an immediate risk to someone's safety, contact the appropriate emergency service.

We may update this policy from time to time, including where we introduce new marketplace features, payment services, delivery options or product categories, or where applicable legal or regulatory requirements change.

Where appropriate, we will notify users of material changes.

The version published on Prerode will state when it was last updated.
